    摘要:

    我国营养相关立法已经有了基本框架,涉及到法律、行政法规、规章、国家标准等多个层面。确立了国家的宏观指导引导义务,也为营养保障提供了基本的制度保障。但仍需要明确具体的监管主体,进一步明确其营养职能定位,进而扩大营养保障的范围,提升营养标准的实体要求。具体地,法律层面应当尽快制定营养保障的基本法,确立营养保障的基本框架;行政法规应当在上位立法的授权下进一步明确营养保障的具体监管机构以及其职权划分;规章层面应当针对不同食品领域的特色进一步细化具体的营养监管标准;并且应当制定单独的营养价值国家标准。

    Abstract:

    Basic legal framework has been established in China about rules of law, administrative rules, regulations, national standards and other levels. It is clear of the macro-guidance and instruction obligation of the government, and the basic legal protection of the nutrition providence. However, the specific regulator and its corresponding roles still need to be clarified, so that the coverage of the nutrition protection can be expanded, and the substantive standards of the nutrition can be promoted. Specifically, at the law level, a basic law on nutritional security should be formulated as soon as possible to establish the basic framework for nutritional security; administrative regulations should, under the authorization of the previous legislation, further define the specific regulatory bodies for nutritional security and the division of their powers; at the regulatory level, specific nutritional regulatory standards should be further refined to cater for the special characteristics of different food areas; and separate national standards for nutritional value should be formulated.
